Government Decree 121/2024 (VI.10.)
on the rules of liability insurance in respect of vehicles participating in motor sport events
The Government, under the authorization given in
subsection bi) of point b) of paragraph (1) of 79. § of Act I of 2004 on Sports,
and in respect of paragraph (9) and (10) under the authorization given in subsection bc) of point b) of paragraph (1) of 79. § of Act I of 2004 on Sports
acting in accordance with its powers under Article 15(1) of the Fundamental Law, hereby orders the following:
1.§ For the purposes of this Government Decree, a racing vehicle is a land vehicle driven by a power engine and participating in a motor sport event as defined in 2.§. For the purposes of this Government Decree, a motor vehicle other than the vehicle defined in Joint Decree No 1/1975 (II. 5.) KPM-BM on the rules governing road transport shall also be considered as a racing vehicle if it is participating in a motor sport event as defined in 2.§.
2.§ This Government Decree shall apply to competitions, training, tests and demonstrations organized with the participation of motor vehicles in a restricted and demarcated area, if they comply with the sports activity listed in paragraph (1) of 1.§ of Act I of 2004 on Sports, or directly related to it (hereinafter together referred to as "motor sport events").
3.§ Motor sport events may only be held with
a)organizer's liability insurance and
b)third-party liability insurance for the racing vehicles.
4.§ (1) The organizer or the director of a motor sport event (hereinafter collectively referred to as the organizer) shall obtain the organizer's liability insurance in connection with the motor sport event no later than the beginning of the first official program of the motor sport event as set out in the timetable.
(2)Under the organizer's liability insurance, compensation for damage caused to third parties by the organizer must be provided for the entire duration of the motor sport event.
5.§ (1) The organizer shall arrange for third-party liability insurance for the racing vehicles in connection with the motor sports event no later than the day before the motor sports event begins, or, if the owner or operator of the racing vehicle arranges for the third-party liability insurance for the racing vehicle, the organizer shall ensure that only racing vehicles with third party liability insurance for racing vehicles may participate in the motor sports event.
(2)The third-party liability insurance for racing vehicle is intended to cover damage caused by a competitor to a third party during a motor sport event by his/her racing vehicle, excluding damage caused by competitors to each other.
(3)The contract of third-party liability insurance for a racing vehicle must include a cover
a)in the case of motor sport events which are part of European or World Championship rounds organized by International Automobile Federation (FIA) and International Motor Sport Federation (FIM), at the level required by the above international sports federations;
b)in the case of motor sport events other than the ones defined in point (a), for motor racing events up to a minimum of HUF 14 million per event and for car racing events up to a minimum of HUF 20 million per event.
6.§ This Government Decree shall enter into force on the fifteenth day following its publication.
7.§ Within 60 days as of the entry into force of this Government Decree, measures shall be taken to review and, where necessary, amend existing liability insurance contracts in accordance with this Government Decree.
8.§ This Government Decree is intended to comply with Directive (EU) 2021/2118 of the European Parliament and of the Council amending Directive 2009/103/EC relating to insurance against liability in respect of the use of motor vehicles, and the enforcement of the obligation to insure against such liability.
9.§ Paragraph (1) of 1.§ of Government Decree No. 54/2004 (III. 31.) on the security of sporting events (hereinafter: R.) shall be amended with following d) point:

"d) Government Decree 121/2024 (VI. 10.) on the rules of liability insurance for motor vehicles participating in motor sport events (hereinafter referred to as "motor sport event")."
10.§ The following Article 12/A shall be inserted in the R:
"§ 12/A If the behavior of the participants of a motor sport event endangers the safe conduct of the event, in particular if some of the spectators attempt to watch the motor sport event from an area closed to spectators and do not cease their behavior despite being called upon to do so, the organizer shall suspend the motor sport event in order to make further calls for action effective or, if this does not lead to results, close the event."
